Terms of Use for the Future Play Festival Website and Related Digital Services

Please read carefully: These Terms govern your use of the website and digital services. Event admission, tickets, tournament participation, contests, and individual activations may be subject to additional rules, waivers, or third-party terms.
1. Acceptance of These Terms
These Terms & Conditions (the “Terms”) are a binding agreement between you and CINEMATIC (“Cinematic,” “Future Play,” “we,” “us,” or “our”).
They govern your access to and use of futureplayfestival.com and any webpages, forms, content, features, communications, and other digital services that link to these Terms. We refer to these collectively as the “Services.”
By accessing or using the Services, you agree to these Terms and acknowledge our Privacy Policy. If you do not agree, do not use the Services.
If you use the Services on behalf of an organization, you represent that you have the authority to bind that organization.
2. Eligibility and Minors
You must be at least 13 years old to use the Services.
If you are under the age of legal majority where you live, you may use the Services only with permission and supervision from a parent or legal guardian.
Certain festival areas, concerts, competitions, purchases, promotions, or activations may:
- Have higher age requirements
- Require identification
- Require a parent or guardian to sign a waiver
The Services are intended for a general audience and are not directed to children under 13. A parent or guardian who believes a child under 13 has provided personal information should contact us promptly.
3. Information, Registration, and Communications
When you submit a form, request information, register for an opportunity, or otherwise interact with the Services, you agree to provide accurate, current, and complete information.
You are responsible for:
- Activity conducted through any registration credentials or links issued to you
- Protecting those credentials and links from unauthorized use
If you sign up for announcements, updates, offers, or similar communications, you consent to receive them electronically. You may unsubscribe from promotional email by using the link included in the message.
We may still send non-promotional messages when needed to:
- Respond to a request
- Administer a registration
- Provide a transaction or safety notice
- Comply with the law
4. Tickets, Payments, and Third-Party Sellers
The Services may link to one or more third-party ticketing, registration, payment, travel, lodging, tournament, or merchandise providers.
Purchases and registrations made through those providers are also governed by their terms and privacy practices. The provider—and not necessarily Cinematic—may process payment-card information and issue confirmations, tickets, credentials, or refunds.
Festival admission and Future Play After Dark concert admission may require separate tickets. A festival ticket does not include concert admission unless the ticket description expressly says otherwise.
Before completing a purchase, review:
- The event name
- The date and venue
- The admission level
- Age restrictions
- Fees
- The delivery method
- Refund terms
- Any event-specific rules displayed at checkout
Except where required by law or expressly stated in the applicable ticket terms, ticket sales and fees may be final and nonrefundable.
Lost, stolen, copied, resold, transferred, or invalid tickets may be subject to the applicable seller’s policies. We are not responsible for tickets purchased from unauthorized sellers.
5. Event and Program Information
Festival information is provided for planning and promotional purposes.
The following details may change, be delayed, relocated, substituted, suspended, or canceled:
- Dates and times
- Locations
- Performers and speakers
- Teams and games
- Activities
- Sponsors and vendors
- Prizes
- Capacities
- Production elements
- Other program details
Admission may be limited because of capacity, weather, safety, security, venue rules, technical conditions, artist or partner availability, governmental action, or circumstances beyond our reasonable control.
Unless required by law or stated in the applicable ticket terms, a change in lineup, schedule, activation, sponsor, or program element does not by itself entitle a user to a refund.
Official refund or rescheduling information, if applicable, will be communicated through the relevant ticket seller or official Future Play channels.
6. Tournaments, Contests, Promotions, and Activations
Esports tournaments, qualifiers, cosplay contests, sweepstakes, giveaways, creator opportunities, airsoft experiences, remote-control racing, gaming stations, and other programs may be governed by separate:
- Official rules
- Eligibility standards
- Releases
- Safety instructions
- Codes of conduct
- Publicity permissions
- Waivers
If separate rules conflict with these Terms, the separate rules control for that program.
Participation may require:
- Age or identity verification
- School or team eligibility
- Equipment checks
- Consent to broadcasting
- Compliance with game-publisher requirements
- Execution of a release
Prizes may be subject to verification, taxes, substitutions, and other restrictions stated in the official rules.
We may remove or disqualify a person for:
- Cheating
- Tampering
- Harassment
- Unsafe conduct
- Violation of program rules
- Conduct that threatens the integrity or reputation of Future Play or its partners
7. Safety and On-Site Requirements
Some festival activities involve physical exertion, props, simulated equipment, lasers, pyrotechnics, theatrical effects, loud sound, flashing or strobing lights, crowds, food and beverages, or other conditions that may present risks or sensitivities.
You must follow all:
- Posted rules
- Staff directions
- Venue policies
- Age restrictions
- Safety instructions
Do not participate in an activity if you cannot do so safely. Separate on-site terms, releases, or waivers may apply.
These Terms do not replace any ticket terms, venue conditions of entry, participant waiver, tournament agreement, health or accessibility notice, or emergency instruction applicable to an in-person event.
8. Acceptable Use
You may use the Services only for lawful, personal, and informational purposes or for legitimate business inquiries directed to Future Play.
You may not:
- Violate any law, regulation, third-party right, official rule, or security requirement
- Copy, scrape, crawl, harvest, index, frame, mirror, republish, sell, or commercially exploit the Services or their content without written permission
- Interfere with the operation or security of the Services
- Probe for vulnerabilities, introduce malware, overload infrastructure, or bypass access controls
- Impersonate another person or organization
- Submit false information
- Misuse another person’s contact information
- Engage in fraud or deceptive conduct
- Harass, threaten, abuse, discriminate against, or invade the privacy of another person
- Upload or transmit unlawful, infringing, defamatory, obscene, sexually exploitative, dangerous, or otherwise harmful material
- Use automated systems, bots, or artificial means to obtain tickets, registrations, entries, benefits, or an unfair competitive advantage
9. Intellectual Property
The Services and their content—including text, graphics, photographs, video, audio, logos, event names, layouts, designs, software, and compilations—are owned by or licensed to Cinematic and are protected by intellectual-property and other laws.
Subject to these Terms, we grant you a limited, revocable, nonexclusive, and nontransferable license to access and use the Services for their intended purpose. No other rights are granted.
Third-party names, game titles, artist names, team names, trademarks, and logos belong to their respective owners. Their appearance does not imply sponsorship, endorsement, or affiliation except where expressly stated.
You may not use Future Play or Cinematic branding or imply an official relationship with us without prior written permission.
10. User Submissions
If you submit comments, messages, photographs, videos, ideas, feedback, contest materials, social content, or other material through the Services, we refer to that material as “User Content.”
You retain ownership of your User Content.
You grant Cinematic a worldwide, nonexclusive, royalty-free license to host, store, reproduce, adapt, publish, display, distribute, and otherwise use your User Content as reasonably necessary to:
- Operate the Services
- Respond to you
- Administer the applicable opportunity
- Protect rights and safety
- Promote Future Play when you submit content for promotional use
- Promote Future Play when you tag an official Future Play account in a manner that invites resharing, using the media and context reasonably understood from your submission
You represent that:
- You have all rights and permissions needed for the User Content
- Our permitted use of the User Content will not violate another person’s rights
Do not submit:
- Confidential information
- Content you do not have permission to share
- Content depicting a minor unless you are authorized to provide the required consent
We are not required to use or retain User Content and may remove it where permitted.
11. Feedback
If you provide suggestions or feedback about Future Play or the Services, you grant us the right to use that feedback without restriction or compensation.
We will not identify you publicly without permission unless the feedback was submitted for public use.
12. Third-Party Services and Links
The Services may contain links, embeds, integrations, or content provided by:
- Ticket sellers
- Tournament platforms
- Social networks
- Analytics and advertising providers
- Venues
- Sponsors
- Vendors
- Artists
- Hotels
- Transportation providers
- Other third parties
We do not control and are not responsible for their services, availability, content, security, terms, or privacy practices.
A link or integration does not necessarily constitute an endorsement. Use third-party services at your own discretion.
13. Copyright Concerns
If you believe material on the Services infringes your copyright, send a written notice to Support@wearecinematic.com containing:
- Identification of the copyrighted work
- Identification and location of the allegedly infringing material
- Your contact information
- A statement that you have a good-faith belief that the use is not authorized
- A statement made under penalty of perjury that the notice is accurate and that you are authorized to act
- Your physical or electronic signature
We may remove the material or contact the submitting user as appropriate.
14. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”
CINEMATIC DISCLAIMS ALL EXPRESS OR IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND SECURITY.
WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT EVENT INFORMATION WILL ALWAYS BE COMPLETE OR CURRENT.
Some jurisdictions do not allow certain warranty exclusions, so some exclusions may not apply to you. Nothing in these Terms limits rights that cannot lawfully be waived.
15. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CINEMATIC AND ITS AFFILIATES, OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING FROM OR RELATED TO THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THEIR TOTAL LIABILITY FOR CLAIMS ARISING FROM OR RELATED TO THE SERVICES WILL NOT EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS (US $100) OR THE AMOUNT YOU PAID DIRECTLY TO CINEMATIC TO USE THE SERVICES DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
This limit does not apply to liability that cannot lawfully be limited. It does not alter rights or remedies under applicable ticket terms or consumer law.
16. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Cinematic and its affiliates, owners, officers, employees, contractors, licensors, and service providers from claims, losses, liabilities, damages, judgments, costs, and reasonable attorneys’ fees arising from:
- Your unlawful use of the Services
- Your User Content
- Your violation of these Terms
- Your infringement of another person’s rights
This obligation does not apply to the extent a claim results from Cinematic’s own negligence, willful misconduct, or violation of law.
17. Suspension and Termination
We may restrict, suspend, or terminate access to the Services, remove content, or cancel a digital registration if we reasonably believe you have:
- Violated these Terms
- Created a security or legal risk
- Engaged in fraud or abuse
- Threatened the integrity of the Services
Provisions that by their nature should survive termination will remain in effect, including intellectual-property, disclaimer, liability, indemnity, and governing-law provisions.
18. Governing Law and Disputes
These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules.
Except where applicable law gives you the right to bring a claim elsewhere, any court proceeding arising from the Services will be brought in the state or federal courts located in Los Angeles County, California. You consent to the jurisdiction of those courts.
Before filing a claim, you and Cinematic agree to make a good-faith effort to resolve the dispute informally through written notice and by allowing at least 30 days for a response.
This section does not prevent either party from seeking urgent injunctive relief or using small-claims court where eligible.
19. Changes to the Services or Terms
We may update the Services and these Terms.
The “Effective” date shows when these Terms were last revised. Material changes will be communicated as required by law, such as by posting a notice or requesting renewed agreement.
Your continued use after an update becomes effective constitutes acceptance of the revised Terms where permitted by law.
20. General Terms
These Terms, together with the Privacy Policy and any applicable program, ticket, venue, or promotion terms, constitute the entire agreement concerning the Services.
If a provision is unenforceable, it will be modified to the minimum extent necessary, and the remaining provisions will remain in effect.
Our failure to enforce a provision is not a waiver.
You may not assign these Terms without our consent. We may assign them as part of a merger, reorganization, sale, or transfer of the Services or business.
